Even though individuals who have a valid medical marijuana card can legally use marijuana in Montana, there is no exception that allows those individuals to drive after using the drug. That means even if you have your medical card, you can still be arrested and charged for DUI if your THC level exceeds the statutory limit or an officer has probable cause to believe you are impaired due to marijuana use.
MSU's Student Legal Services program is managed by the Associated Students of Montana State University (ASMSU). Please thank your student government for prioritizing legal services for MSU students!
